Terms of Service (Public Offer)

1. General Provisions

This document (the "Offer") is a public offer under Articles 435 and 437 of the Civil Code of the Russian Federation, made by Self-employed Lobanova Margarita Yu. (TIN 631405036718) (the "Contractor", "Operator"), and contains all the essential terms of the paid services agreement (Article 779 of the Civil Code of the Russian Federation).

Acceptance of the Offer (conclusion of the agreement) is the registration of the User on the YesDay service located at yesday-wedding.ru (the "Service") and/or the payment for services in accordance with Article 438(3) of the Civil Code of the Russian Federation.

The User confirms having read this Offer and the Privacy Policy and unconditionally agrees with them before starting to use the Service.

2. Subject of the Agreement

The Contractor undertakes to provide the User with paid services for access to the YesDay software and hardware complex for creating, configuring and hosting a wedding website on the *.yesday-wedding.ru subdomain, and the User undertakes to accept and pay for such services under the terms of this Offer.

3. Definitions

• User — a capable individual who has accepted the Offer.
• Contractor (Operator) — Self-employed Lobanova Margarita Yu.
• Service — the software complex located at yesday-wedding.ru.
• Wedding Website — a web page created by the User on the *.yesday-wedding.ru subdomain.
• Account — the User's record in the Service.
• Tariff — the cost and scope of services at the current price.
• Trial Period — a free period of use of the Service.
• Content — any data, texts, photographs, images and other materials uploaded by the User to the Service.

4. Registration and Account

4.1. Registration is performed via the User's email address with confirmation of identity through a one-time PIN code sent by the Contractor to the specified email.

4.2. Simple electronic signature. The parties agree that entering the PIN sent by the Contractor to the User's email constitutes a simple electronic signature under Article 6(2) of Federal Law No. 63-FZ "On Electronic Signatures" and is equivalent to a handwritten signature for purposes of performing legally significant actions within this Agreement.

4.3. The User warrants the accuracy of the information provided and is solely responsible for safeguarding their access.

4.4. One individual may create one account. Creation of multiple accounts for the purpose of circumventing restrictions of the Offer is prohibited.

5. Subscription and Payment

5.1. The cost of the paid Service is 1990 Russian roubles for the publication and maintenance of one Wedding Website for 365 days.

5.2. Payment is made through payment service providers (YooKassa and equivalents). The moment of payment is the receipt of funds into the Contractor's account.

5.3. Self-employed tax regime. The Contractor is a payer of professional-income tax (Federal Law No. 422-FZ). A receipt for each payment is generated in the "My Tax" application and sent to the User's email.

5.4. Prices may change. The price in effect at the time of payment applies to services rendered for the paid period.

6. Trial Period

6.1. The Contractor grants the User a free Trial Period of up to 14 days or until the first publication of the Wedding Website, whichever occurs first.

6.2. During the Trial Period the User may design the Wedding Website and evaluate the functionality of the Service. Publication of the Wedding Website on a public subdomain requires activation of the paid Tariff.

6.3. The Trial Period does not automatically convert into the paid Tariff. Automatic debiting of funds does not occur.

7. Refund Policy

In accordance with Article 32 of the Law of the Russian Federation "On the Protection of Consumer Rights", the User may withdraw from the services at any time provided that the Contractor is compensated for actually incurred expenses.

The parties agree that the Contractor's actually incurred expenses are the cost of the proportionally used period of access, calculated by the formula:

Expenses = 1990 ₽ × (days from publication date to withdrawal request / 365)

Refund amount = Amount paid − Expenses.

Refund is made using the same payment method within 10 business days from the date of receipt by the Contractor of a written request at info@yesday-wedding.ru.

Refunds are not issued in case of termination due to the User's violation of this Offer.

8. Intellectual Property

8.1. All rights to the Service — including design, templates, source code, trademarks, images and other elements — belong to the Contractor and are protected by Articles 1259, 1484 of the Civil Code of the Russian Federation.

8.2. The User is granted a non-exclusive, non-transferable right to use the Service within the functional capabilities provided for the duration of the paid period and the Trial Period.

8.3. User Content (photographs, texts, names, etc.) belongs to the User. The User grants the Contractor a royalty-free non-exclusive licence to use Content strictly for the purpose of providing the services (storage, reproduction, making available to the public within the Wedding Website) for the duration of the Agreement.

9. Content Policy and Prohibitions

The User undertakes not to use the Service to place Content that:

• violates the legislation of the Russian Federation, including materials containing extremism, terrorism, child pornography, narcotic substances, or calls to such (Articles 10, 15.1 of Federal Law No. 149-FZ);
• is associated with phishing, scams, fraud, unwanted redirects, or imitates third-party brands;
• contains personal data of third parties without their consent;
• infringes intellectual property rights (third-party photographs without a licence);
• is used for spam or mass mailing;
• advertises gambling, financial pyramids, unregulated cryptocurrencies, or "grey" schemes;
• contains political agitation, incitement to hatred, or defamation;
• contains malicious code, scripts, or JS injections;
• uses the Wedding Website not for its direct purpose (marketing landing pages, commercial stores under the guise of weddings).

Information intermediary status. The Contractor is an information intermediary within the meaning of Article 1253.1 of the Civil Code of the Russian Federation and does not carry out prior moderation of Content. The Contractor is not liable for Content placed by the User, subject to the conditions of Parts 3 and 4 of Article 1253.1 of the Civil Code of the Russian Federation.

10. Moderation and Suspension

10.1. The Contractor has the right to restrict access to or completely suspend the Wedding Website without prior notice upon discovering content that violates clause 9 of the Offer, upon receipt of requests from government authorities, or upon reasoned complaints from third parties.

10.2. The User is notified of the suspension by email with reasons.

10.3. The User may contest the suspension by sending an appeal to info@yesday-wedding.ru. Response time — within 10 business days.

10.4. In case of termination due to the User's violation of clause 9, paid funds are not refunded.

11. User's Liability

The User is responsible for:

• the accuracy of the data provided upon registration;
• the Content placed and its compliance with the legislation of the Russian Federation;
• obtaining consent from third parties (partner, guests, relatives) to the processing of their personal data by the Operator;
• the safekeeping of access details to the Account.

Recourse. Should claims be brought against the Contractor by third parties (including state authorities) in connection with Content placed by the User or inaccurate information, the User undertakes to reimburse the Contractor for all losses incurred, including court costs and fines.

12. Limitation of the Contractor's Liability

12.1. To the extent permitted by the legislation of the Russian Federation, the Contractor's aggregate liability to the User is limited to the amount actually paid by the User in the 12 months preceding the event giving rise to liability.

12.2. The Contractor is not liable for:

• actions of third parties (payment systems, hosting providers, messengers, domain registries);
• malfunctions of communication networks, the User's equipment or software;
• consequences of the User's use of their credentials;
• the content of materials posted by the User (Article 1253.1 of the Civil Code);
• indirect damages, lost profits.

12.3. The limitation of liability does not apply to cases when damage is caused with intent or gross negligence of the Contractor, nor to cases established by imperative norms of the legislation of the Russian Federation.

13. Service Availability "As Is"

The Service is provided on an "as is" basis. The Contractor makes reasonable efforts to ensure continuity of operation but does not guarantee uninterrupted or error-free operation. Planned technical works are carried out, where possible, with a minimum of 24-hour notice published on the Service.

14. Force Majeure

The parties are released from liability for failure to perform obligations in the event of circumstances of insurmountable force under Article 401 of the Civil Code of the Russian Federation, including but not limited to: large-scale DDoS attacks; failures at infrastructure providers (hosting, payment systems, communication operators); actions of state authorities; blocks by telecommunications regulators; changes in legislation that make fulfilment impossible.

15. Changes to the Terms

The Contractor has the right unilaterally to amend this Offer. The new version is published on this page at least 10 calendar days before the effective date. Continued use of the Service after the effective date means acceptance of the new version.

16. Termination

16.1. The User may terminate the Agreement at any time by deleting the account and/or sending a notice to info@yesday-wedding.ru.

16.2. The Contractor may terminate the Agreement in case of a material violation by the User of this Offer with prior notice of at least 3 calendar days, except for cases of urgent suspension under clause 10.

16.3. After termination, the User's data are stored for up to 30 calendar days for the purposes of possible recovery, then irrevocably deleted.

17. Dispute Resolution

17.1. A pre-trial claim procedure is mandatory. Claims are sent to info@yesday-wedding.ru. Response time — 30 calendar days.

17.2. Disputes are to be resolved in accordance with the rules of jurisdiction established by Article 17 of the Law of the Russian Federation "On the Protection of Consumer Rights" and Article 29 of the Code of Civil Procedure of the Russian Federation — at the plaintiff-consumer's discretion (place of residence of the User, place of contract conclusion or performance, or place of the Contractor).
